Disappearance cannot be taken as death: Supreme Court
The Supreme Court has reiterated that civil presumption of death arises only after seven years of continuous disappearance and that the disappearance date cannot automatically be treated as the date of death.
Setting aside a high court order linked to compassionate appointment, the apex court underscored that the presumption’s legal consequences trigger only after the statutory period and subject to evidentiary scrutiny. The ruling matters for insurance claims, succession, pensions, and service-law disputes, where precise dating determines eligibility and liability.
Lower courts have been urged to adopt an evidence-based approach—examining police records and circumstances—rather than defaulting to mechanically back-dating death. Legal practitioners say the judgment will reduce forum shopping and harmonise administrative decisions across states.
