India’s Supreme Court has agreed to hear a petition next week seeking to restrain Chief Election Commissioner Gyanesh Kumar from exercising his official duties.

A bench led by Chief Justice Surya Kant agreed to early listing of the case following submissions by senior advocate Vikas Singh, representing petitioner Rakesh Kumar Singh.

The petition alleges that Kumar acted unilaterally on at least 14 critical decisions between October 2025 and August 2026, bypassing the statutory multi-member framework of the Election Commission of India. Under the law, decisions of the three-member body must be made unanimously or by majority consensus.

According to the filing, Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi formally recorded objections to several measures, including decisions related to a Special Intensive Revision (SIR) of electoral rolls.

The petition requests the court to suspend Kumar pending a final decision, restrain him from acting as commissioner, and order a Special Investigation Team (SIT) led by a retired Supreme Court judge to probe the matter.

The court is scheduled to take up the matter next week.
